WaiverPay LLC ("WaiverPay," "Company," "we," "us," or "our") is committed to protecting the privacy and security of information provided to us. This Privacy and Security Policy ("Policy") describes the manner in which we collect, use, store, disclose, and safeguard information obtained through our website, applications, underwriting processes, and ongoing business operations (collectively, the "Services"). This Policy is incorporated by reference into and forms a part of our Terms of Service. By accessing or using the Services, you acknowledge and agree to be bound by this Policy. If you do not agree, you must immediately discontinue use of the Services.
HIPAA Compliance
To the extent applicable, WaiverPay operates in accordance with the Health Insurance Portability and Accountability Act of 1996, as amended, and its implementing regulations ("HIPAA"). WaiverPay may act as a "business associate" in connection with certain services provided to covered entities. Any protected health information ("PHI") disclosed to WaiverPay shall be subject to the terms of a duly executed Business Associate Agreement ("BAA") and handled in accordance with applicable HIPAA privacy and security requirements. WaiverPay does not assume any obligations under HIPAA unless and until such BAA is executed.
Modifications to This Policy
WaiverPay reserves the right, in its sole discretion, to modify or update this Policy at any time. Any such modifications shall be effective upon posting. Your continued use of the Services following the posting of an updated Policy constitutes your acceptance of the revised terms. WaiverPay shall have no obligation to provide direct or individualized notice of such changes beyond updating the "Last Updated" date above.
Information We Collect
WaiverPay may collect information that identifies, relates to, describes, or is reasonably capable of being associated with an individual or business ("Personal Information") for purposes including underwriting, verification, servicing, and ongoing business operations. Such information may be collected directly from you or through authorized third-party sources. Personal Information may include, without limitation, identifying information such as names, addresses, telephone numbers, account identifiers, and other similar data; records of services purchased, obtained, or considered; financial and transactional information, including but not limited to tax-related information and bank account details; internet or electronic network activity information, including device data, browser type, usage data, timestamps, and cookies; professional or employment-related information; and any other information reasonably necessary to provide the Services or comply with applicable law.
Use of Information
WaiverPay uses Personal Information as necessary to evaluate eligibility for services, including underwriting and approval determinations; to provide, operate, maintain, and improve the Services; to support internal business operations; to enhance security and prevent fraud; to communicate with users regarding their accounts and transactions; and to comply with applicable legal and regulatory obligations.
Disclosure of Information
WaiverPay does not sell Personal Information. WaiverPay may disclose Personal Information to the extent necessary to (i) comply with applicable laws, regulations, legal processes, or governmental requests; (ii) facilitate the provision and administration of the Services; (iii) engage service providers, vendors, or partners who are contractually bound to maintain confidentiality and implement appropriate safeguards; or (iv) effectuate a merger, acquisition, financing, or sale of all or a portion of WaiverPay's business or assets. WaiverPay does not disclose Personal Information to unauthorized third parties.
Data Retention and Security
WaiverPay retains Personal Information only for as long as reasonably necessary to fulfill the purposes for which it was collected, including to satisfy legal, accounting, or reporting requirements. WaiverPay implements commercially reasonable administrative, technical, and physical safeguards designed to protect Personal Information against unauthorized access, disclosure, alteration, or destruction. Notwithstanding the foregoing, no method of transmission or storage is completely secure, and WaiverPay does not guarantee absolute security. In the event of a data breach involving Personal Information, WaiverPay will provide notice as required by applicable law.
User Rights
Subject to applicable law, you may have the right to request access to, correction of, or deletion of Personal Information maintained by WaiverPay, as well as the right to request restrictions on certain processing activities or to withdraw consent where applicable. WaiverPay reserves the right to deny or limit such requests to the extent permitted by law, including where necessary to comply with legal obligations or enforce contractual rights.
